ADR: Starting July 22, remote video identification of persons will be recognized only with approval
Starting July 22, 2022, remote person identification by means of video will only be recognized if the remote person identification service provider has obtained the approval from ADR, in accordance with the Rules regarding the regulation, recognition, approval or acceptance of the procedure of remote identification of the person using video means.
On November 24, 2021, it was published in Official Gazette No. 1119 Decision of the President of the Authority for the Digitization of Romania by which the Norms regarding the regulation, recognition, approval or acceptance of the remote person identification procedure using video means were approved.
The Authority for the Digitization of Romania (ADR) announces the end of the transition period for the entry into force of the rules regarding the regulation, recognition, approval or acceptance of the remote person identification procedure using video means, according to the provisions in force in the Decision of the President of the ADR approved and published in the Monitor Officially in 2021. Economic operators or institutions that use remote identification by video means had a period of 8 months to come to terms with them.
This period of technical harmonization has ensured that the technological platforms developed so far in this direction can be adapted to the norms without there being a period of interruption. The transition period ended yesterday, July 21, 2022. According to chapter III, art. 23, of the normative act ADR exercises the control and supervision of compliance with the rules in force, through the specialized structure within the institution. According to the rules, in the event of non-compliance with the legal provisions found by the ADR control staff within the Information Society Service, the Authority is empowered to intervene to correct the irregularities, including measures can be taken regarding the withdrawal of the technical approval. The remote person identification activity by means of video by the providers of remote person identification services by means of video, registered in Romania, can be carried out, from this moment, only after obtaining the opinion issued by the Authority for the Digitization of Romania, according to art. 25 of the norms in force.
“Until now, documents have been submitted to the Authority for the Digitization of Romania for approval, both by trust service providers, payment service providers, credit institutions and non-banking financial institutions. Also, in the process of verifying the person’s identity at a distance using video means, the services provided by third parties can be used under a contract”, stated Dragoș Cristian Vlad, the president of ADR.
To date, three trust service providers and one banking entity have received ADR approval for video identification, and only one third party has been added to the list of third party identity verification. The procedure to be followed by third parties as well as their list can be consulted on the ADR website.
