The Romanian market offers many opportunities for both Ukrainian entrepreneurs and newly established companies to operate, as well as multiple opportunities for Ukrainians who want to settle in Romania, and their employment is encouraged by Romanian companies. By publishing in the Official Gazette number 231 / 08.03.2022 of the Emergency Ordinance 20 of March 7, 2022, it was allowed to modify and complete certain normative acts, as well as to establish measures of support and humanitarian assistance.
“Due to the war in Ukraine, many individuals and companies had the only option to leave the country for their own safety and look for a new place in the countries of the region in order to continue their daily life and economic activities. To support them, Romania has come up with a set of legislative measures to facilitate their access to Romania, as well as the rights to health, education, employment, but also the protection of vulnerable people. Also, the measures provided in the Emergency Ordinance encourage civil society, the private sector and individuals to continue making donations for the benefit of Ukrainian refugees, and international organizations to have a simpler mechanism of collaboration “, said Laura Ștefan, Managing Director of Accace Romania.
Ukrainian IT and research companies relocating to Romania can access state incentives
Ukrainian citizens and businesses relocated to Romania can benefit from an incentive plan from the Romanian state. Thus, individuals working as IT specialists or in the field of Research and Development can benefit from a 10% exemption from the standard income tax under certain conditions mentioned in the Romanian domestic legislation. On the other hand, companies operating in Romania and in accordance with the legislation in force may benefit from an additional 50% tax depreciation for eligible research and development expenses and may apply accelerated depreciation for these expenses, but also the tax exemption on profit reinvested in certain types of assets.
The main fiscal provisions of the Ordinance aim to introduce in the categories of deductible expenses the amounts represented by cash donations granted by individuals and legal entities to the General Inspectorate for Emergency Situations (IGSU) to support citizens from the armed conflict zone in Ukraine. The introduction of new regulations for expenditures on goods, financial means and services provided to UNICEF and other international organizations, which carry out their activity according to special agreements to which Romania is a party. Also, Ukrainian citizens who have entered Romania legally and who do not apply for asylum in Romania, can be employed without a work permit. In this context, the employment on the market of Ukrainian citizens who do not have documents proving the professional qualification or work experience necessary for employment, can be achieved, for a period of 12 months, with the possibility of extension with periods of 6 months.
