This creates new risks of misinformation and manipulation at scale, fraud, impersonation, and consumer deception.<\/p>\n\n\n\n<p>The new transparency obligations will\u00a0<strong>help people recognise when they are interacting with AI<\/strong>\u00a0or are\u00a0<strong>exposed to AI-generated content<\/strong>, so they can make informed decisions and better protect themselves from misinformation or deception.\u00a0<\/p>\n\n\n\n<p>AI is advancing quickly, making it increasingly difficult to distinguish AI-generated and manipulated content from human-created and authentic content. This creates new risks of misinformation and manipulation at scale, fraud, impersonation, and consumer deception.<\/p>\n\n\n\n<p>The new transparency obligations will&nbsp;<strong>help people recognise when they are interacting with AI<\/strong>&nbsp;or are&nbsp;<strong><a href=\"https:\/\/audiovisual.ec.europa.eu\/corporateplayer\/index.html?ref=I-293312&amp;lg=EN&amp;sublg=none&amp;autoplay=true\">exposed to AI-generated content<\/a><\/strong>, so they can make informed decisions and better protect themselves from misinformation or deception.&nbsp;<\/p>\n\n\n\n<p><strong>Transparency obligations for providers and deployers of certain AI systems<\/strong><\/p>\n\n\n\n<ul><li><strong>Marking and labelling of AI-generated content:<\/strong>&nbsp;certain AI-generated or manipulated content must be clearly and visibly labelled and include machine-readable marks. The EU has created a&nbsp;<strong><a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/eu-icons-labelling-ai-generated-content\">set of icons<\/a>&nbsp;<\/strong>that can be used for this purpose. This applies to<ul><li>images, audio, and video&nbsp;content that resemble existing persons, objects, places, entities, or events (deepfakes)<\/li><li>emotion recognition and biometric categorisation tools<\/li><li>text published to inform the public on matters of public interest where there has been no human review or editorial control.&nbsp;<\/li><\/ul><\/li><li><strong>Transparency when interacting with an AI system:<\/strong>&nbsp;Users must be clearly informed when they are not interacting with a real person, but an AI system, for example a chatbot, AI agent, and avatar.<\/li><\/ul>\n\n\n\n<p>The Commission has published&nbsp;<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/guidelines-transparency-ai-generated-content\"><strong>guidelines<\/strong><\/a>&nbsp;to assist providers and deployers of AI systems in meeting these transparency obligations. The guidelines explain how compliance can be demonstrated, including through adherence to a&nbsp;<strong><a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/code-practice-ai-generated-content#1720699867912-0\">code of practice<\/a>.<\/strong><\/p>\n\n\n\n<p><strong>Enforcement of the rules and sanctions<\/strong><\/p>\n\n\n\n<p><a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/market-surveillance-authorities-under-ai-act\"><strong>National market surveillance authorities<\/strong><\/a>, the European&nbsp;<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-office\"><strong>AI Office<\/strong><\/a>&nbsp;(for systems under its supervision), and the&nbsp;<a href=\"https:\/\/www.edps.europa.eu\/_en\"><strong>European Data Protection Supervisor<\/strong><\/a>&nbsp;(when EU institutions are providers or deployers) are responsible for enforcing the transparency rules and may issue fines&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<ul><li>up to&nbsp;\u20ac15 million, or 3% of global annual turnover,&nbsp;for companies<\/li><li>up to \u20ac750k for EU institutions, bodies, and agencies&nbsp;<\/li><li>with proportionality taken into account for small and medium-sized enterprises (SMEs) and small mid-cap companies (SMCs)<\/li><\/ul>\n\n\n\n<p>The<strong>&nbsp;<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/regulatory-framework-ai\">AI Act<\/a>&nbsp;<\/strong>entered into force on 1 August 2024. Its provisions apply in stages, with different obligations taking effect at different times. The Act creates a single market and&nbsp;<strong>harmonised rules for trustworthy AI in the EU<\/strong>&nbsp;and&nbsp;<strong>promotes AI innovation and uptake<\/strong>. It also&nbsp;<strong>addresses potential risks<\/strong>&nbsp;to people\u2019s health, safety, and fundamental rights, while&nbsp;<strong>safeguarding democracy and the rule of law<\/strong>.
