{"id":13720,"date":"2025-08-05T11:49:06","date_gmt":"2025-08-05T11:49:06","guid":{"rendered":"https:\/\/outsourcing-today.ro\/?p=13720"},"modified":"2025-08-05T11:49:06","modified_gmt":"2025-08-05T11:49:06","slug":"nndkp-from-governance-to-enforcement-what-applies-under-the-ai-act-as-of-august-2025","status":"publish","type":"post","link":"https:\/\/outsourcing-today.ro\/?p=13720","title":{"rendered":"NNDKP: From Governance to Enforcement: What Applies Under the AI Act as of August 2025"},"content":{"rendered":"\n<p><strong>On 2 August 2025, a new set of provisions under\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2024\/1689\/oj\/eng\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation (EU) 2024\/1689 on Artificial Intelligence (the AI Act)<\/a>\u00a0became applicable.<\/strong><\/p>\n\n\n\n<p>As of this date, the following main provisions have entered into force:<\/p>\n\n\n\n<ul><li>The formal establishment of the European AI Board \u2013\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-board\" target=\"_blank\" rel=\"noreferrer noopener\">this body has already been constituted and has held several meetings<\/a>. The expectations are that the AI Board to play a key role in the EU AI governance framework, including through the issuance of recommendations and written opinions.<\/li><li>The rules governing General Purpose AI (GPAI) models \u2013 notably, just one day before these obligations became applicable,\u00a0<a href=\"https:\/\/digital-strategy.ec.europa.eu\/en\/policies\/ai-board\">the European Commission and the AI Board confirmed that the GPAI Code of Practice is recognised as an \u201cadequate voluntary tool\u201d for providers of GPAI models to demonstrate compliance with the AI Act<\/a>.<br><em>Note: The GPAI Code of Practice is a voluntary instrument, developed by independent experts, intended to support providers of GPAI models in meeting their obligations under the AI Act.<\/em><\/li><li>The designation of notifying authorities and notified bodies \u2013 it remains to be seen which authority\/authorities will be entrusted in Romania with the responsibilities of notifying authority (this being the main regulator under the AI Act).<\/li><li>The enforcement and sanctioning regime \u2013 the general enforcement provisions of the AI Act are now applicable, with the exception of the fines specific to GPAI providers \u2013 in a nutshell, the AI Act sets out a tiered system of administrative fines for non-compliance. Violations of the prohibition on certain AI practices can trigger the highest fines\u2014up to EUR 35 million or 7% of global annual turnover. Breaches of other obligations may lead to fines of up to EUR 15 million or 3% of global annual turnover.
